Official Rules

Offer open to legal residents of the 50 United States and District of Columbia, 13 years of age or older, except for residents of Maine who must be 18 years of age or older. Begins at 12:00:00 pm (noon) Eastern Time ("ET") on 1/12/10 and ends, except as set forth below, while supplies last, at 11:59:59 am ET on 1/13/10 ("Offer Period"). LIMIT ONE GIFT PER PERSON AND PER HOUSEHOLD.

Twitter Followers of dentynegum will be sent a tweet at approximately 12:00:00 pm (noon) ET on 1/12/10 offering the opportunity to receive a free sample bottle of Dentyne gum, while supplies last, when they follow all of the Offer Instructions below.

If you are not a Twitter Follower of dentynegum, you may participate in the Offer, while supplies last, by first becoming a Twitter Follower of dentynegum and then, follow the Offer Instructions below. To become a Twitter Follower of dentynegum, do the following: a) During the Offer Period, visit www.twitter.com and login to your account. If you do not have a Twitter account you may sign-up for free at www.twitter.com; b) From your Twitter home page, click on the "Find People" tab and perform a search for "dentynegum"; c) Click on the "Follow" icon button to the right of the dentynegum Twitter Feed.

Offer Instructions:
To receive a free sample bottle of Dentyne gum, while supplies last, do all of the following:

1. Take a picture of an empty car cup holder (hereafter, "Photo") using a digital camera or wireless device which has email capabilities;
2. During the Offer Period, and no later than 11:59:59 am ET on 1/13/10, post your Photo on twitpic.com in one of two ways: A) Online: visit twitpic.com, login with your Twitter username and password, click on the "Upload Photo" link, follow the provided instructions to upload the Photo, insert "#emptycupholder" AND "@dentynegum" in the message space indicated and finally, click "upload". NOTE: The Photo must be posted to your Twitter account in order to be eligible; or B) Email via Mobile Device: To post your Photo via email using your mobile device, email the Photo to the Twitpic email address assigned to your Twitter account including "#emptycupholder" AND "@dentynegum" in the subject line. If you do not know the twitpic.com email address assigned to your Twitter account, visit twitpic.com, login with your twitter username and password, click on "Upload Photo" link and your assigned email address will be provided on that page. 3. Upon verification of the posted Photo, dentynegum will, in the order of Photo posting, send a Twitter direct message or @reply to each participant inclusive of a web address and instructions to claim a sample bottle of Dentyne gum, while supplies last. To claim a sample bottle of Dentyne gum, while supplies last, between 12:00:00 pm ET on 1/12/10 and 11:59:59 am ET on 1/13/10, visit the provided web address and follow the instructions provided to complete and submit the Offer Form. Gift will be mailed 8-10 weeks following verification.

The participants who do all of the above will receive a sample bottle of Dentyne gum, while supplies last. Exact flavor and size of sample bottle of gum at Cadbury's sole discretion. Notwithstanding anything to the contrary in these Official Rules, Cadbury may cancel or modify this Offer at any time in its sole discretion due to unexpected demand.

To be eligible, Photo must primarily focus on an empty car cup holder, and no individuals or other identifiable third party materials may appear in the Photo. Additionally, to be eligible, Photo must also (i) be taken by you; (ii) be your original creation and solely owned by you; (iii) not contain any person or materials embodying the names, likeness or indicia of a third party; (iv) in a jpeg format and no more than 5MB in size; (v) not have been previously published or submitted in any promotion; (vi) not have been previously screened or publicly viewed.

Tweets, emails, requests, claims and Photo Uploads generated by script, macro or other automated means or by any means which subvert the participation process will be void. Cadbury Adams USA LLC (“Cadbury”) and its parent, subsidiaries, affiliated companies, suppliers, distributors, retailers, advertising & promotion agencies and (collectively, the “Released Parties”) are not responsible for late, lost, stolen, incomplete, misdirected, delayed, garbled, damaged, inaccurate or undelivered tweets, direct messages, @replies, emails or Photos, or for telephonic, human or computer failures, problems or errors, interruptions in service due to system upgrades, repairs, modifications or other causes, failures or malfunctions of connections, satellite, network, cable, Internet Service Provider (ISP), cellular tower, wireless service, phones, phone lines or telephone systems, traffic congestion on the internet, technical or mechanical malfunctions, or other malfunctions or errors, whether caused by equipment, programming, human error or otherwise relating to or in connection with the Offer, including, without limitation, errors which may occur in connection with the administration of the Offer, the processing of Offer requests or claims, direct messages, @replies, emails or Photo postings, the incorrect uploading of any photo, for any injury or damage to participant’s or any other person’s computer, wireless device or other device relating to or resulting from participation in this Offer, or for printing, typographical, human or other errors appearing in these Official Rules, on Twitter.com (and related sites) or other Offer-related materials. By participating, each participant (and, if an eligible minor, his/her parent or legal guardian) agrees that Cadbury and its designees shall have the right and permission to use in any manner (unless prohibited by law) participants’ name, city and state of residence for advertising and/or trade and/or promotion and/or any other purpose online, including, but not limited to, www.dentyne.com, and in any and all venues or media now or hereafter known anywhere in the world in perpetuity without further compensation, permission or notification to participant or any third parties, except where prohibited by law. By submitting a Photo, you (and if you are an eligible minor, your parent or legal guardian) hereby grant permission to Cadbury (and agree to represent (if requested to do so), in a form satisfactory to Cadbury, that you have the right to grant to Cadbury) a non-exclusive, perpetual, worldwide, irrevocable, sub licensable (through multiple tiers), assignable, fully paid, royalty free, license to display the Photo on www.twitpic.com, www.dentyne.com and other Cadbury websites, and to otherwise use, exploit, copy, modify, adapt, edit, publish, and display the Photo (in whole or in part), and to incorporate the Photo in other works, in any form, manner, venue, media, or technology now known or later developed, for any and all purposes, including, without limitation, for purposes of trade, advertising and promotion, as, and to the extent, Cadbury or its designees may determine, in any and all media now known or hereafter devised, without further compensation, notification or permission. Participant (and, if an eligible minor, his/her parent or legal guardian) agrees that Released Parties are not responsible for any unauthorized use of Photos by third parties. Released Parties do not guarantee the posting or other use of any Photo. Limit one (1) gift per person and per household. No substitutions or transfers will be allowed. Not valid in combination with other offers. For Offer requests not in compliance with all terms of this Offer Cadbury has no obligation to acknowledge or return such request or fulfill a gift in combination with such requests. Return of any gift/Offer request as undeliverable will result in forfeiture of the gift. No group/organization requests will be honored. All materials submitted become the property of Cadbury and will not be returned. By participating, participants agree to be bound by Twitter’s Terms of Service, available at http://twitter.com/tos, these Offer Official Rules and the decisions of Cadbury, which are final and binding. Persons who tamper with or abuse any aspect of the Offer, as solely determined by Cadbury, will be disqualified. Should any portion of the Offer be, in Cadbury’s sole opinion, compromised by non-authorized human intervention or other causes, which, in the sole opinion of the Cadbury, corrupt or impair the administration, security, fairness or submission of information, Cadbury reserves the right at its sole discretion to terminate the Offer.
